Donors may request access to their personal information, request corrections to inaccurate information, or request deletion of their information, subject to our legal and recordkeeping obligations.

Charitable Solicitation Disclosures

Excel by Eight is registered as a charitable organization with the State of Arkansas as required by applicable law. All fundraising solicitations conducted by or on behalf of Excel by Eight comply with applicable state and federal charitable solicitation laws. Donations to Excel by Eight are tax-deductible to the extent permitted by law. Upon request, Excel by Eight will provide information about the percentage of contributions that are used for charitable purposes versus administrative and fundraising expenses.

IRS Compliance and Recordkeeping

Excel by Eight maintains records of donor contributions as required by the Internal Revenue Code and IRS regulations applicable to 501(c)(3) organizations. We provide written acknowledgment of contributions as required by IRS regulations, including for any single contribution of $250 or more. Excel by Eight does not provide goods or services in exchange for donations unless specifically disclosed at the time of the solicitation, in which case the tax-deductible portion of the donation will be clearly stated. Donor information may be disclosed to the IRS or other government authorities as required by law or in connection with an audit or investigation.

How We Share Your Information

Excel by Eight does not sell personal information. We may share your information in the following circumstances:

Data Breach Notification

In accordance with the Arkansas Personal Information Protection Act, if we become aware of a security breach that results in unauthorized access to personal information that creates a reasonable likelihood of harm to affected individuals, we will notify affected individuals and, if required, the Arkansas Attorney General, within forty-five (45) days of discovering the breach or as otherwise required by law.

Data Retention

Excel by Eight retains personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, and reporting requirements. In determining the appropriate retention period, we consider the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process the information; and applicable legal requirements.

Donor records and contribution information are retained in accordance with IRS recordkeeping requirements for tax-exempt organizations, which generally require retention for at least seven (7) years. Other personal information is retained for the period necessary to fulfill the purposes described in this Policy.

Depending on your location and applicable law, you may have certain rights regarding your personal information:

Access and Correction

You may request access to the personal information we maintain about you and request that we correct inaccurate or incomplete information.

Deletion

You may request that we delete your personal information, subject to certain exceptions, such as when retention is required for legal compliance or to complete a transaction you requested.

Opt-Out of Communications

You may opt out of receiving promotional emails by following the unsubscribe instructions included in those emails or by contacting us directly. Even if you opt out of promotional communications, we may still send you transactional or administrative messages, such as donation receipts or information about your participation in our programs.

We will respond to requests within a reasonable timeframe, and in any event within the time required by applicable law.

Children’s Privacy

Excel by Eight is committed to protecting the privacy of children. Our website is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen (13) through our website without verifiable parental consent.

COPPA Compliance

In compliance with the Children’s Online Privacy Protection Act (COPPA), if we learn that we have collected personal information from a child under thirteen (13) without parental consent, we will delete that information as quickly as possible. Program Participants

When children participate in Excel by Eight programs, we collect personal information only with the consent of a parent or guardian. Parents and guardians have the right to review the personal information collected about their child, request deletion of such information, and refuse further collection or use of their child’s information.

Arkansas Children and Teens’ Online Privacy Protection Act

Excel by Eight acknowledges the protections afforded to children and teens under the Arkansas Children and Teens’ Online Privacy Protection Act, which takes effect on July 1, 2026. As a nonprofit organization, Excel by Eight is exempt from certain provisions of this law; however, we are committed to protecting the privacy of minors in accordance with best practices and applicable law.

Third-Party Websites and Services

Our website may contain links to third-party websites or services that are not operated by Excel by Eight. This Policy does not apply to those third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services you visit.

When you make a donation through a third-party payment processor, that processor’s privacy policy and terms of service govern its handling of your payment information. We have selected reputable, secure payment processors that comply with industry standards, including the Payment Card Industry Data Security Standard (PCI-DSS).

Changes to This Privacy Policy

Excel by Eight may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes to this Policy, we will post the updated Policy on our website with a new effective date. We encourage you to review this Policy periodically.

The Policy in effect at the time you submitted personal information to us will generally govern our use of that information unless you consent to an updated Policy.

Governing Law and Bylaws Compliance

This Policy and any disputes arising out of or relating to this Policy or your use of our website shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Excel by Eight complies with all applicable Arkansas laws relating to data privacy and protection, including the Arkansas Personal Information Protection Act, which requires entities that collect personal information to implement reasonable security procedures and practices and to notify affected individuals and, in certain circumstances, the Arkansas Attorney General in the event of a data breach.

Bylaws Compliance

This Privacy Policy is consistent with and implements the following provisions of the Excel by Eight Bylaws:

Organizational Structure. Excel by Eight is an Arkansas nonprofit corporation with its principal office at 1405 Pine Valley Road, Little Rock, Arkansas 72207. The corporation operates exclusively for charitable purposes under Section 501(c)(3) of the Internal Revenue Code and does not have voting members. (Bylaws Art. II, § 2.01; Art. III, §§ 3.01–3.04; Art. IV, § 4.01)

Nondiscrimination. Excel by Eight does not discriminate on the basis of race, creed, ancestry, marital status, gender, sexual orientation, age, physical disability, veteran’s status, political service or affiliation, color, religion, or national origin. (Bylaws Art. XII, § 12.03)

Donor Records. Donor records are maintained internally and are accessible only to personnel with direct managerial responsibility for donor relations. Donor records shall not be disclosed externally except to governmental agencies as required by law. Donors may consult with Excel by Eight staff regarding records pertaining to their own donations. (Bylaws Art. XV, § 15.07)

Staff Records. Staff records are maintained internally and are accessible only to personnel with direct managerial responsibility. Staff members may consult with appropriate personnel regarding their own records. (Bylaws Art. XV, § 15.06)

Public Disclosure. Excel by Eight provides the following documents to the public free of charge: IRS Forms 990, 990-T, 1023, and 5227; the organization’s Bylaws; Conflict of Interest Policy; and annual financial statements. (Bylaws Art. XV, § 15.02)

Board Transparency. Board deliberations, minutes (once accepted), and materials considered by the Board are open to the public except where the Board passes a motion designating specific portions as confidential. (Bylaws Art. XV, § 15.05)

Document Retention. Excel by Eight maintains records in accordance with the retention schedule set forth in the Bylaws, including permanent retention of Articles of Incorporation, Bylaws, Board minutes, tax-exemption documents, and audit reports; seven-year retention of financial and accounting records, donor records, and tax returns; and three-year retention of general correspondence and internal reports.
